1.Roadway dining setups must be clean and clear of debris, vermin and unsanitary conditions while in operation. Roadway setups cannot be used for trash or storage of any kind at any time of day. Violators will be notified to clean their setups and given a cure period to correct violations. If violations persist, operating permits will be revoked until compliance is achieved. Continued non-compliance will result in roadway dining permit removal.
2.Protective Barriers
Width: The minimum width that all roadway setups must have on all 3 sides facing any roadway is 18". A barrier is not required on the side facing the sidewalk.
Height: Minimum height 30"; maximum height 36"
Fill: Minimum = 150 lb/LF of barrier
3.Transparent Shades above Barrier
Enclosure above 36" barrier: no solid walls allowed above barrier height.
Only 100% transparent material above the barrier allowed. Translucent material such as a roller shade or curtain may be permitted. No translucent solid-form material allowed. Materials must provide full visibility above barrier up to 7.5' above curb level at all times.
4."Lightweight and removable” overhead covering or umbrellas to protect diners from inclement weather and/or sun.
Minimum height: 6'-8" Max height: 7'-10” Must be weighted down and not affixed to roadbed or sidewalk.
5. Poles, posts, tent legs, canopy attachments, etc.
All vertical elements must be affixed inside barriers, made of lightweight material, and must be easily and quickly removable due to inclement weather.
Plastic, wood and lightweight aluminum and metal materials are permitted materials.
6.Area of setup inside barriers must not exceed 400 sq ft.

8.Amplified Sound
Electrical noise-creating or sound amplifying devices are not allowed in Open Restaurants setups.Speakers are not permitted in Open Restaurants setups.
9.ADA Access
All access to roadway dining must be ADA compliant and accessible as per NYC Building Code.
